I would say that it's both a scam and illegal. I've never heard of a
separate OEM version of Photoshop. In some cases, Photoshop may be bundled
with hardware, but the licensing terms specifically forbid selling the
software separately. I'd imagine Adobe's lawyers would be VERY interested in
talking to the owner of that web site.

A similar site was reported on another list- in fact the same offer.
Several people who went to the website later had their systems hacked (or
rather someone attempted to hack into their computers).  It's a scam, hit
and run, and should not be promoted, innocently or not, on these lists.

That one, or a similar one, made it into the Adobe Forums, so Adobe 
is aware.
