A member of our group went off half-cocked yesterday and
complained to us (with copies to this abuse address) about our group having a
midi file in our vault that is a public domain performance of the Gershwin piece
Rhapsody in Blue. He erroneously assumed the music still had copyright
protection. I have thoroughly researched this issue, as I do with all such
complaints. The fact is that Rhapsody in Blue is in the public domain,
having been written in 1923. The Harry Fox Agency's site does not list it
as a copyrighted song.
Our group enforces a strict policy of keeping copyrighted
material off of our vault. Once or twice members (unknowingly) uploaded
something that was protected. Another member would notice and report the
problem and the offending material would be removed immediately. Our
standard welcoming message for the group very specifically forbids uploading
copyrighted material. In short, we do everything reasonable within our
power to be a good egroups citizen, consistent with your legal
guidelines.
