Is this from an installer other than the one you get by purchasing 
Panther? A special CD they send because you bought a machine that came 
with Jaguar after Panther was released, maybe? I ask because there is 
no separate Panther Upgrade product; when you buy Panther it's the full 
$129, and you get the full version whether it's a new purchase or you 
already own Jaguar, 10.0, etc.

I bought a new Ibook and it came with a Panther Upgrade CD only. It will not 
allow you to install Panther from scratch. You have to install Jaguar first 
then use the upgrade disk.
