By the way, since this is the OT list, we don't need to put GEN/LAM/OT/WIN or whatever do we? >Depends on the situation. I did a cover of a Tears for Fears song a while >ago. I ended up just using one theme (the marimba theme of the song >"Change") (I didn't use a sample), writing a new song with it, also new >vocals and a new text. We have separated the words and music.... but we >needed approval. I think that is it right there "Permission". The default when you write a song with someone else is 50/50 ownership. Imagine if you wrote a great tune, a friend wrote a crap bridge, you copyright, later you surgerectly remove the malperforming part, and insert a new and improved bridge of your own - you can't do much without the permission/aquience of the other person who now owns 50% of your song. Its depends on his good will, or being paid off at that point. And he might refuse. This is why, its better to make up a standard co-writer contract BEFORE you write the song. Does anyone know of a standard one available on the web? I might have one in a book somewhere. >As someone (can't remember who) pointed out correctly: it often depends of >the strength of those who discuss the deal. Maybe it depends on the size of your lawyer too? There must be some objective criteria though, I would think. By the way, how did your song do?
