The individual pad sounds, like synth patches, are
obviously OK to use. But the preset songs are likely
to be copyrighted. Someone wrote them, after all!
If you have a recording contract and you used a
recognisable chunk of one of the songs - you'd likely
be in breach of copyright. The record company would
need to know this in order to sort out performance &
publishing royalties etc. etc. 

However, it's unlikely Yamaha will come knocking at
your door - so if you're just doing it for fun/local
gigs/personal reasons and maybe selling a few CDRs,
then no-one's going to care. After all, everyone else
is doing it!
