Putting a brief statement concerning the purpose of the list and responsibilities of the members is a very good idea and might solve many problems before they arise. That way we could get away from playing amateur lawyer - which we are probably rally bad at - and get back to talking about photography. I'm one of the moderators on a yahoo list and our standard operating procedure is to review the request for joining. We send them an Email, ask them to briefly tell us who they are and why they would like to be on the list.
