Re: Tron body

Re: Tron body

2004-01-30 by mellotrongirl

Where's the mechanics that was supposed to be in the 'Tron body?
Stuffed into something that looks like a big black synth? I even
wonder if the body is "real" (indicated by perhaps a # penciled in
under a cheekblock or stamped on the inside somewhere) or the owner
built it in a woodshop out back? Then again, you CAN purchase just
the "real" 'Tron shell, y'know...

What a joke the way it is presented on eBay, but then again, there
are those that hotrod integrated Theremins into classic looking
wooden cabinetry like the '30s RCA's...and that to me (for some
unexplainable reason) is a bit more acceptable.

Yes, obviously it is a synth. No mechanics necessary.

Well, if the guy did it at a "woodshop out back" it seems to me that he has
a pretty nice woodshop.
Norm Abrams style. From the pictures, the workmanship appears to be
excellent. And the "real"
tron shell probably is prohibitively expensive (like all other "real"
mellotron parts), especially because it
would be made in England.

I don't think it is a joke. It was presented very accurately, if you ask
me.

Yes, your logic is unexplained. Seems to be the same thing to me.

I'd still be curious to know if it's legal for these folks to be
using the Mellotron name. Anyone know?

I've been wondering that since I first saw it. Reminds me of the use of the
Ferrari emblem on copy cats cars in the 80's. Mr. Ferrari put a quick end to
that noise!

Depends on whether he's trying to pass it off as a product of the
Mellotron factory I think, and probably also dependent on whether it
was done as a one-off by a "whittler" or a production item for
commercial sale. He's only describing it as a replica cabinet, and
there would be nothing illegal in that, nor would there be anything
illegal in selling one of those replica Ferraris unless you try and
pass it off as a real one.

Are there not rules on eBay about selling counterfeit goods?

Mellotron Archives (Dave Kean / Markus Resch) have been building new
mellotons (with the name on them) for four or five years now. They
also have the www.mellotron.com website.... I think they own the
name.

Streety's new production keyboards might be called "Novatron" ?

The "replica" M400 on EBAY is a $150 midi keyboard, with a black
plywood stand (with a control panel built in), a power bar, and a
shipping case. It really shouldn't have the name mellotron on it.

I agree...I would think the fabrication of the control panel would be a
bit of a pain. But if it is not an original panel, then it is copied
from one, silk screened, etc. That I think could be an infringement on
the Mellotron name...Markus?

MARKUS!!

Absolutely... an idiotic product indeed, ,and probably an infringement
of your trademark.

Actually under British law, a manufacturer must produce goods in
several categories to protect against trademark infringement, or other
firms passing off their goods as other brands'. Whilst it is certainly
illegal for another company to produce a keyboard, musical instrument
or similar item with your trademark, unless you produce, or HAVE
produced items in other key categories, they COULD be produced by other
companies using the name MELLOTRON ...

For example:
Every so often, Rolls Royce produce toys, clothes chocolates etc. with
their brand on the label. This prevents other companies creating "Rolls
Royce Candy"..etc.

If this nobhead making Mellotron-alikes decided to produce a range of
clothing called "Mellotron", there's nowt you can do about it....
UNLESS you've previously made it and registered the fact yourself. A
few years ago, you may remember young hip-hop types wearing black
hoodies and carrying Record Bags bearing the TECHNICS logo. These sold
in millions, but were created (legally) by a small clothing company
here in Cheltenham. Because Matsushita (the makers of Panasonic and
Technics) hadn't ever made clothing, and the tiny Cheltenham company
WERE in that business, Matsushita had no rights to the name on a
t-shirt whatsoever! The same company now legally owns the rights to
make flight bags called "Pan-Am"!! Recently, Uncle Bob released a
range of clothing with his logo "moog' printed on the front. "moog
synthesizer" t-shirts have been produced for years quite legally by a
London company called "Mendoza" with no infringement of Bob's rights.
Ironically, if they wanted, they could in all probability sue Bob for
using their name on a t-shirt.

Does Mellotron write computer software? Unless you're in the computer
business, then this is a moot point. Whilst passing off the CD -ROM as
a genuine product of the Mellotron company WOULD be illegal, there is
probably no law at all about some firm calling themselves "Mellotron
Software Ltd" and releasing the "Tron-ROM" or something similar....

ANYONE out there is free to produce Mellotron brand chocolates.... and

Re: Tron body

Heh-heh ...

I remember reading in an interview that Andrew Giddings (modern-era Jethro Tull keyboardist) uses a specially-built wooden shell of a keyboard stand that is designed to look like a Hammond organ. It actually houses two Roland R-70s, which Giddings uses as master MIDI controllers. Apparently, Ian Anderson thought modern MIDI keyboards looked kinda cheesy and undignified for a classic band like Tull, and suggested the idea. I tend to agree. Ha! According to the article, it even fooled Keith Emerson, who approached the Tull keyboardist after a concert and asked: "What model Hammond is that you're using, Giddings?" :-D

It may be heretical, it may be silly, but I rather like the idea of this Tron-style controller. However, it's way overpriced, IMO. I'd like to see one made out of simple foamboard (lightweight, ridged cardboard). I think I may have even seen someone who did this in Keyboard magazine at some time... It sets up and tears down with like Velcro or something. A heck of a lot easier than hauling around a real Tron. And it's got the "Giddings coolness factor."

My friends used to put their Kuzweil in a grand piano-shaped fake cardboard shell just to look cool on stage.

All in good fun! This person just may have taken things a little too far.

Cheers,
Babz
