Samples are legally covered under the Sound Recording "SR" copyright laws, and software is not. Samples and sample-based products are covered the same way as music, so that's why software copyright analogies are misinformed. Check out the legal basis for licensing sound recordings and you'll see that there is decades of case law supporting this in court. Software is a whole other legal animal. -EP
