hello smartypants wearers..(that'll be eric:-))

i had a rather convoluted sample copyright poser come to me 
the other day, please forgive me if this was already covered. (i 
dont recall seeing this during that big old copyright thread..)

lets say i've writen a track containing a bunch of copyright 
samples, i've given credit for them, and then released the track. 
someone else comes along, samples a portion of my track 
which contains said copyright samples but doesnt give any 
credit to either myself or the sample originator, and then has a 
huge hit with their track.
obviously i'd have the right to sue for the use of my original 
portion. 
here's my question: would the sample copyright holder have any 
right to sue me for the use of their samples in this instance?
