Your exactly right. I figured this out late last night with a scope. When using hyperterminal DTR or RTS was asserted at all times, this gave power to my level translator. When using any of the ISP programs they held these lines low and the level converter was not powered. This is something that should have jumped out at me, but I was to blind to see it. Maybe this post will help someone else out in the future. Thanks to all that offered help.
