INKED/FOCUS MAGAZINE SLIMEY THIEF SPIVAK: IS HE STILL IN BROOKLYN?

The latest development is that David S. Spivak no longer has an email 
address at either FOCUS  or INKED. (david@... or david 
@focusmagazine.com)  My emails to both address were returned today as 
Mailer Daemons – unable to deliver.   Now it's fraud and theft. I 
wonder how many other photographers were seduced and screwed  (or 
should I say raped)  by this *****. Beside my 60 bucks, he has a lot of 
my prints which represent my very identity,  hundreds of $$$, plus 
hours of my time. His address as he gave it: 77 Berry St. Suite 1 R,

The above from network solutions, arin had no info when I searched it.
Notice the 2 different addresses given for the registration. So he
MUST be able to be contacted at one of those addresses or his domain

about this, but others may not be so strict.

If any of the transactions were done through the US mail it is mail fraud. 
File a complaint with the US Postal Inspectors.

Contact ASMP, they have lawyers just for this sort of thing. Not sure  
if you need to be a member but it would be worth the fees to join.

You see, here's the confusion! You somehow, magically forgot to tell 
people here that for the $1500, you're given an ad in two issues, 
which is basically $750 per issue and that this is all part of a 
photographer marketing package that I talk about in my letter from 
the publisher in the upcoming issue. We do not believe that 
photography should be included as some kind of contest, we believe 
that fine art photography should be taken seriously which is why we 
developed a Photographer Marketing Package which gives the 
photographer a 5 page gallery, including a 500 word bio and two full 
page advertisements for $1500. That's 3 issues that readers have the 
opportunity to read about your work. There is no scam, here. We 
select photography in which we feel has real marketing value and in 
which we believe to be high in quality, i.e. Arlene Love's street 
photography. Photographers are asked to pay a submission fee and a 
fee for return shipping or shipping materials if they do not wish to 
include the $25. We recently dropped the submission fee to encourage 
more submissions, which has worked.

Arlene has mis-stated the facts and left out vital information. 

As far as getting her prints back, when I had a conversation with 
Arlene about this, I told her that not all photographers have to 
participate in this in order to receive space in the Focus Gallery, 
but that's all they'd receive, without the two ads. I told Arlene 
that I would consider her for that for future issues. Since then, 
there have been two issues, in which I was very close to including 
her photography in this issue that is coming out very soon, but I 
ran out of space at the last second by another photographer who 
wanted to participate in this program. On 4/25, Arlene sent me an e-
mail asking for her prints back. Of course, the prints will be 
returned to her, but I had to finish out this issue first before I 
took care of that.

Several photography magazines wait 6 months before returning prints 
back to photographers. As we speak, I am organizing all of the 
submissions that I have and hers was in the stack to return. Had she 
actually bothered to pick up a copy of the magazine, where my e-mail 
address is everywhere as is the web address, she could have gotten 
in touch with me sooner and let me know it was urgent for her to 
receive her photography back. She failed to do that, therefore, the 
photographer had to wait until it was convenient for myself or 
someone else to return the prints.
