Yes, I have noticed the same problem. I was using the "short empty pattern" workaround before, but now I just make a pattern that is a copy of the one I was going to use, but with the tracks I had wanted muted - just erased. Then I can go into the original pattern and mutes all work fine after that. It does end up using an extra pattern but if you are tricky with the song mode then you can really get all the variation you need. I've never seen a "pattern-chain" style song sequencer that lets you use just specific portions of the pattern like the MD... it rox! Hopefully there will be a fix soon... I think I'll send the Elektron guys a bug report.
