It's a common complaint that several people have voiced on the VSL 
Forum.  We are all waiting for a "real" fix to the legato tool.
In the meantime you select the track in the arrange window which has 
the errant exs instrument and press spacebar.  This resets the tool.  I 
find I sometimes have to press it a few times to reset.
